Brazilian Supreme Court Justice Dias Toffoli on 15 July declared all judicial acts undertaken by Operation Lava Jato against Alberto Youssef null and void, citing what he called a “conluio” between the then-judge Sergio Moro, federal prosecutors and police investigators. In a 53-page ruling, Toffoli said the coordination between judge and accusers violated due-process guarantees and tainted the evidence, including 260 hours of clandestine recordings made in a federal-police cell in 2014. The decision extinguishes sentences that had exceeded 120 years for the former currency dealer, who was one of the first detainees and principal collaborators in the anti-corruption probe centred on Petrobras contracts. Toffoli maintained the validity of Youssef’s 2014 plea bargain, meaning financial penalties and testimony linked to the agreement formally remain in force. Sergio Moro, now a senator, criticised the ruling, saying it rewards impunity, while Youssef’s defence argued he had been coerced into cooperating. The judgment continues a series of STF moves since 2023 that have dismantled major portions of Lava Jato, including decisions benefiting businessmen Léo Pinheiro and Marcelo Odebrecht. Legal experts expect the latest annulment to trigger new challenges to cases that relied on Youssef’s testimony and evidence gathered by the Curitiba task force.
