The Federal Maritime Commission (FMC) has finalized a new rule aimed at addressing the unreasonable refusal to deal by ocean carriers. This rule largely prohibits ocean carriers from refusing to provide vessel space for their customers' containers. The FMC's decision follows complaints that ocean carriers have been intentionally stifling competition in merchant-haulage chassis to enjoy lower rates for carrier haulage. The rule also includes provisions for assessing ocean carriers' denial of cargo space.
