An exasperated Sixth Circuit panel on Thursday looked for an easy way to dismiss Kentucky's and industry groups' appeal of the dismissal of their challenges to a federal government rule defining the scope of the Clean Water Act. The panel appeared unconvinced during oral arguments by Kentucky’s attempt to challenge a federal waters rule that has since been amended by the Biden administration.
