The Supreme Court of India has emphasized the importance of not imposing excessive bail conditions, equating them with no bail at all. This stance was highlighted in a recent judgment on Friday where the court advised caution in setting bail terms to ensure they do not undermine the purpose of granting bail. Additionally, the court, led by Justice Hima Kohli, has directed jail superintendents to process applications of first-time offenders under Section 479 of the BNSS. The court also ruled that Section 479, which addresses the maximum detention period for undertrial prisoners, will apply retrospectively to those who have served one-third of their maximum sentence.
