The U.S. Justice Department has expressed support for consumers seeking to revive a price-fixing lawsuit against major Las Vegas hotels. In an amicus brief submitted to the 9th Circuit, the DOJ highlighted concerns that the use of computer algorithms by these hotels to determine pricing creates 'new dangers' for consumers. Concurrently, Live Nation Entertainment and its subsidiary Ticketmaster have been ordered by the 9th Circuit to face a proposed class action lawsuit alleging they charged excessively high ticket prices. The court upheld a previous ruling from 2023 that prevents Live Nation from enforcing arbitration clauses that would require consumers to resolve disputes outside of court. Additionally, a $418 million settlement involving the National Association of Realtors concerning home sales commissions is currently under scrutiny, as several groups have urged a federal judge in Missouri to reject the agreement, claiming it is overly broad and may impede other pending lawsuits.
