Loudoun County Public Schools has suspended two Stone Bridge High School juniors for 10 days after the district’s Title IX office concluded the boys committed sexual harassment and sex-based discrimination by questioning why a female student who identifies as male was in the boys’ locker room. The incident was captured on a cellphone video recorded by the transgender student, a practice that violates district policy, according to documents reviewed by local media. In addition to the suspension, the boys were given a no-contact order and must meet with administrators to craft a “corrective action plan.” Attorney Josh Hetzler, who represents the families, said the district informed parents of the sanctions late Friday and that they plan to appeal. Virginia Attorney General Jason Miyares previously labeled the investigation retaliatory and referred the matter to the U.S. Departments of Education and Justice. He argues the district’s process suppressed the students’ religious or moral objections to sharing intimate spaces with the opposite sex. The disciplinary action comes amid a broader standoff between federal officials and five Northern Virginia school systems, including Loudoun. After the districts refused to amend policies that let students choose bathrooms and locker rooms based on gender identity, the U.S. Department of Education on Tuesday placed them on “high-risk” grant status, limiting access to federal aid to a reimbursement basis and beginning proceedings that could halt future funding entirely. Education Secretary Linda McMahon said the step was necessary because the divisions “openly violate federal law while receiving federal funding.” Loudoun officials cite the Fourth Circuit’s 2020 ruling in Grimm v. Gloucester County, which found restricting transgender students from facilities aligned with their gender identity is discriminatory. The Founding Freedoms Law Center says it will pursue all legal avenues to overturn the boys’ suspensions, setting up another legal clash as classes resume later this month.
