A federal judge ordered U.S. Immigration and Customs Enforcement to overhaul conditions at its short-term holding facility on the 10th floor of Manhattan’s 26 Federal Plaza, siding with migrants who said they were crammed onto concrete floors without basic necessities. In a temporary restraining order issued Tuesday, U.S. District Judge Lewis A. Kaplan limited occupancy to 50 square feet per person, directed ICE to provide sleeping mats, and required the rooms to be cleaned three times a day. The agency must supply soap, towels, toilet paper, feminine hygiene products, bottled water and a third daily meal on request, as well as prompt access to medication and medical personnel. Kaplan also demanded that detainees receive free, confidential and unmonitored phone calls with attorneys within 24 hours of arrival and at least every 12 hours thereafter, with interpreter services and written notices of these rights posted in multiple languages. The order stems from a class-action lawsuit filed 8 Aug. by Sergio Alberto Barco Mercado and advocacy groups Make the Road New York, the New York Civil Liberties Union and the American Civil Liberties Union. Their affidavits describe detainees held for up to two weeks, sleeping near open toilets, denied soap and medication, and fed what they called inedible "slop." Justice Department lawyer Jeffrey S. Oestericher told the court only 26 people were being held on 12 Aug., far below the fire-marshal limit of 154, and conceded the facility offers no beds or mats while denying persistent overcrowding claims. The government says detainees are meant to stay less than 72 hours. Kaplan scheduled a preliminary-injunction briefing later this month; the temporary order expires in 14 days unless extended. The case could influence standards for short-term immigration detention as federal enforcement actions escalate.
