A federal judge in Maryland has again blocked the Trump administration from deporting Salvadoran migrant Kilmar Abrego Garcia, extending a temporary restraining order that bars his removal to Uganda until at least early October. At a hearing on Wednesday, U.S. District Judge Paula Xinis said Abrego Garcia must remain in the United States while she weighs his habeas petition. Xinis scheduled an evidentiary hearing for Oct. 6 and pledged to issue a ruling within 30 days. She ordered Immigration and Customs Enforcement to keep the 30-year-old in custody at a Virginia detention center and barred officials from moving him more than 200 miles from her courthouse in Greenbelt, Maryland. Abrego Garcia was taken back into ICE custody on Aug. 25 during a routine check-in, just three days after his release from a Tennessee jail where he awaits trial on charges of conspiring to transport undocumented migrants. In March, U.S. authorities deported him to El Salvador despite a 2019 order protecting him from removal to that country; he was returned to the United States in June after the government acknowledged the deportation was improper. The administration now seeks to send Abrego Garcia to Uganda, a nation with which he has no ties. He is pursuing asylum and has asked, in the alternative, to be removed to Costa Rica should deportation ultimately proceed. Judge Xinis said the October hearing will examine whether officials followed required procedures and obtained adequate assurances about conditions in Uganda before attempting the transfer.
