The Kenyan High Court has declared the National Government Constituency Development Fund (NG-CDF) unconstitutional, citing violations of the principles of separation of powers, devolution, and duplication of roles. The Court stated that some of the responsibilities assigned to MPs under the NG-CDF should be handled by county governments. Judges Kimondo and Aburili were among those who ruled on the case. The National Assembly plans to appeal the decision. Additionally, the Court has granted MPs two years to complete pending projects under the NG-CDF. In a separate ruling, the High Court also declared the Privatisation Act, 2023 unconstitutional due to a lack of meaningful public participation and for excluding the oversight role of the National Assembly. This ruling halts the proposed sale of several state-owned entities, including the Kenyatta International Convention Centre (KICC), Kenya Seed Company, and Kenya Literature Bureau, with the Court recognizing KICC as a national monument.
