New York police have arrested Charles Burgess, a 32-year-old resident of Dayton, Ohio, on two counts of assault for allegedly hurling a sex toy toward the court during the New York Liberty’s Aug. 5 game against the Dallas Wings at Brooklyn’s Barclays Center. The object struck a 12-year-old girl in the leg, causing pain but no hospitalization, according to the New York City Police Department. Burgess surrendered at the NYPD’s 78th Precinct on Aug. 20 and was released pending a December court date after pleading not guilty, his attorney said. Surveillance video cited in court filings purportedly shows him pulling the object from his clothing before the throw. Investigators had circulated images of the suspect for more than two weeks before the arrest. The case is the third arrest linked to a spate of sex-toy throwings that have disrupted WNBA games in Atlanta, Chicago, Los Angeles and Phoenix since late July. In earlier incidents, local authorities detained an 18-year-old in Phoenix and a 23-year-old in Georgia on assault and disorderly-conduct allegations. The WNBA said arena safety remains a “top priority” and warned that anyone tossing objects onto the court faces immediate ejection and at least a one-year ban from league venues. Law-enforcement agencies are coordinating with the league to pursue criminal charges where warranted.
