The Calcutta High Court on Friday asked the Delhi Chief Secretary to file a detailed report by 16 July on whether Bengali-speaking migrant workers from West Bengal were detained in the capital and, if so, on what legal grounds. The order came while hearing two habeas corpus petitions filed by relatives of six workers—Sweety Bibi, Kurban Sheikh, their minor son, Sunali Khatun, Danish and Danish’s minor grandson—who were allegedly picked up in Delhi’s Rohini area on 18 June and handed to the Border Security Force on suspicion of being Bangladeshi nationals. A division bench of Justices Tapabrata Chakraborty and Reetobroto Kumar Mitra said the court “cannot be a silent spectator” in the matter. It directed the Delhi administration to submit all documents related to the purported detention, specify any court orders under which the action was taken, and state whether the detainees were informed of the reasons for their custody. The bench also instructed the West Bengal Chief Secretary to liaise with his Delhi counterpart and file a concurrent report on the same date. The case was adjourned till 16 July, when the court will decide on further action, including possible production of the detainees. On the previous day, the same bench sought similar clarifications from the Odisha government over allegations that two other migrant workers from West Bengal were being held unlawfully in Jagatsinghpur district. The series of orders underscores the court’s growing scrutiny of interstate treatment of migrant labourers amid heightened concerns over wrongful detention.
