A federal appeals court has ruled that a Massachusetts public middle school did not violate a student's free speech rights under the U.S. Constitution by requiring the student to stop wearing a T-shirt that said 'There are only two genders.' The First Circuit Court ruled on June 9, siding with Nichols Middle School in Middleborough, which had barred the eighth-grader from wearing the shirt to protect LGBTQ+ students from discrimination. The student's attorneys are considering a Supreme Court appeal, arguing that the decision infringes on the student's First Amendment rights.
