Forty-four of the nation’s largest law firms have been hit with a discrimination complaint alleging that they use an outside staffing agency to hire summer interns based on race. The complaint was filed with the Equal Employment Opportunity Commission (EEOC) by an anti-diversity, equity, and inclusion (DEI) group representing three white applicants who claim discrimination in the DEI summer fellowship programs. The nonprofit organization that places incoming law students in these internships, along with its affiliated law firms, is under investigation for allegedly racially biased hiring practices. These firms had previously pledged to end DEI hiring initiatives as part of agreements with the Trump administration. The case is expected to lead to further clashes between Big Law and the current administration, with potential congressional investigations also being discussed. The dispute raises questions about disparate impact liability in employment law, particularly in the context of diversity-focused internship programs.
