Both Justice Kagan (today, in Smith and Wesson Brands, Inc v. Estados Unidos Mexicanos) and Justice Sotomayor (in Garland v. Cargill) have now conceded in opinions that the AR-15 meets Heller's "in common use" standard. Here are the relevant sections. https://t.co/iowMiE6NOk
The opinion further highlights that “the AR–15 is the most popular rifle in the country.” https://t.co/qLkvITSNlx
The U.S. Supreme Court recently issued split decisions on two gun-related cases, including a challenge to Maryland's ban on AR-15 rifles. The rulings indicate skepticism among some justices regarding the constitutionality of the ban. Notably, Justice Elena Kagan, in the case Smith and Wesson Brands, Inc v. Estados Unidos Mexicanos, acknowledged that the AR-15 is the most popular rifle in the United States and meets the "in common use" standard established in the landmark Heller decision. Justice Sonia Sotomayor made similar observations in a separate case, Garland v. Cargill. Kagan highlighted that Mexico specifically targeted military-style assault weapons such as AR-15s, AK-47s, and .50 caliber rifles in its regulations. These opinions represent some of the most consequential Second Amendment dicta from the Court in recent years.
