Supreme Court Justice Samuel Alito has temporarily halted a Fifth Circuit ruling from July that deemed the enforcement provisions of a law regulating horse safety as an unlawful delegation of governmental authority to a private entity. The Horseracing Integrity and Safety Authority requested the Supreme Court to block the Fifth Circuit’s decision, allowing the law to remain in effect nationwide while litigation continues. The case, brought by Republicans, has been in litigation for over five years and has significant national implications. The Fifth Circuit is considered the most conservative in the country.
