Loudoun County Public Schools has suspended two male students at Stone Bridge High School for ten days after a district Title IX investigation concluded the boys committed sexual harassment and sex-based discrimination by questioning why a female student who identifies as male was in the boys’ locker room. The punishment also bars the boys from contact with the complainant and requires a corrective action plan; a third student originally investigated was cleared. The incident began earlier this year when the female student recorded the boys inside the locker room—a violation of district rules. While the recording prompted the inquiry, the district focused its findings on the boys’ comments rather than the filming. Families represented by attorney Josh Hetzler and the Founding Freedoms Law Center say the process was biased and intend to appeal, arguing the decision could stain the teenagers’ academic records as they prepare college applications. One family has already moved out of Virginia. Virginia Attorney General Jason Miyares previously called the district’s investigation unlawful and retaliatory, referring the matter to the U.S. Department of Education’s Office for Civil Rights and the Justice Department. Miyares contends the inquiry infringed the students’ religious beliefs and chilled speech on transgender policies. The case comes as the Education Department last week placed Loudoun and four other Northern Virginia districts on “high-risk” grant status for refusing to roll back policies that let students use facilities matching their gender identity. The designation, announced by Education Secretary Linda McMahon, shifts funding to a reimbursement basis and begins proceedings that could suspend or terminate federal aid worth tens of millions of dollars. Loudoun officials have not commented on the individual suspensions, saying only that the district follows a comprehensive Title IX procedure. The school board maintains its stance is required under the Fourth Circuit’s Grimm v. Gloucester County ruling, and it has said it will not revise Policy 8040 despite federal pressure.
