The Trump administration on 27 August released a draft regulation that would replace the open-ended “duration of status” system with fixed time limits for several categories of temporary visa holders, tightening oversight of students, exchange visitors and foreign journalists. Under the proposal issued by the Department of Homeland Security, F-class visas for international students and J-class visas for cultural-exchange participants would be capped at four years. I-class visas for members of the media would be limited to 240 days, while journalists holding Chinese passports would face a 90-day ceiling. All groups could apply for extensions, subject to additional scrutiny. The rule could affect roughly 1.6 million students, 355,000 exchange visitors and about 13,000 foreign media representatives who were present in the United States in fiscal 2024. DHS says the change is needed to improve its ability to “monitor and oversee” temporary residents and estimates compliance costs of about $390 million over the next decade. The public has 30 days to comment on the proposal, which revives a similar initiative floated by Trump in 2020 and rescinded by the Biden administration in 2021. The measure is part of a broader effort by Trump’s second-term White House to tighten rules governing legal immigration.
