A federal grand jury in Washington, D.C., has refused to indict Sean Charles Dunn, a 37-year-old former Justice Department paralegal, on a felony assault charge for throwing a wrapped submarine sandwich at a U.S. Customs and Border Protection officer on Aug. 10. The encounter, captured on video near the busy 14th and U Streets nightlife corridor, showed Dunn shouting “I don’t want you in my city!” before hurling the sandwich at the agent’s chest. He was fired from the Justice Department after his arrest. Prosecutors from the U.S. Attorney’s Office had sought a felony indictment, but grand jurors declined earlier this week, an outcome considered rare given the typically low evidentiary bar for such proceedings. Under the federal Speedy Trial Act, prosecutors now have roughly 30 days from Dunn’s arrest to decide whether to present the case to another grand jury or pursue lesser misdemeanor charges that do not require an indictment. The setback is the second in recent days for prosecutors pressing felony assault cases against people accused of attacking federal officers during President Donald Trump’s law-enforcement surge in the capital, which officials say has produced more than 1,000 arrests since Aug. 11. The string of grand-jury refusals underscores mounting legal challenges facing the Justice Department as it follows orders to bring the most severe federal charges possible against alleged offenders.
