A three-judge panel of the U.S. Court of Appeals for the Second Circuit heard arguments on Wednesday, 11 June 2025, in President Donald Trump’s effort to overturn his New York hush-money conviction by shifting the case to federal court. Trump’s lawyers, joined by representatives of the Justice Department, told the panel that the 34 felony counts should be reviewed under federal jurisdiction in light of a recent Supreme Court ruling expanding presidential immunity. They maintained the state trial court lacked authority and that transferring the matter would open a path to dismiss the verdict entirely. The appellate judges took the request under advisement and did not indicate when they will rule. A decision in Trump’s favor could allow him to petition the Supreme Court to erase the conviction, which remains unsentenced and has made him the first sitting U.S. president to hold office after being found guilty of a felony.
