A federal judge in Boston temporarily barred the Trump administration from enforcing a provision of its newly enacted tax-and-spending package that would have cut off Medicaid reimbursements to Planned Parenthood. U.S. District Judge Indira Talwani on Monday issued a 14-day temporary restraining order directing the Department of Health and Human Services to keep payments flowing “in the customary manner and timeframes” to the reproductive-health provider and its affiliates. The lawsuit, filed the same day by Planned Parenthood Federation of America and its chapters in Massachusetts and Utah, argues the so-called “Defund Provision” in the One Big Beautiful Bill Act amounts to an unconstitutional bill of attainder and retaliation for the group’s advocacy of abortion rights. The measure bars Medicaid payments for one year to any nonprofit that both performs abortions and received at least $800,000 in Medicaid funds in fiscal 2023 — a definition Planned Parenthood says was crafted to single it out. The organization said more than 1 million of its patients rely on Medicaid for services such as cancer screenings and birth-control prescriptions. Talwani’s order gives HHS two weeks to object before a July 21 hearing on a longer injunction. A White House official said the administration remains committed to ending taxpayer support for elective abortions, setting up a likely legal battle over the Medicaid cutoff. The judge’s ruling is the first judicial roadblock to President Donald Trump’s signature domestic legislation, signed on Independence Day.
