A new legal challenge is underway to overturn the landmark Supreme Court decision Obergefell v. Hodges, which legalized same-sex marriage nationwide in 2015. Former Kentucky clerk Kim Davis is appealing a jury award to a gay couple whose marriage license she denied, arguing that Obergefell should be overturned similarly to Roe v. Wade. Her brief to the 6th Circuit cites arguments from Justices Clarence Thomas and Samuel Alito in the Dobbs decision. A legal group has also filed a brief supporting Davis, suggesting that the Supreme Court should revisit and potentially overturn same-sex marriage rights. Clarence Thomas has previously indicated that the Court should revisit Obergefell.
A legal group filed a brief on behalf of a former KY county clerk that it says could lead to SCOTUS overturning same-sex marriage rights. Court docs point specifically to overturn of Roe, saying the court should overturn Obergefell for the same reasons. https://t.co/wAqa9gT75a
