The Trump administration has threatened to seize or license Harvard University’s lucrative intellectual-property portfolio after ordering a comprehensive review of the school’s federally funded research. In an Aug. 8 letter seen by Reuters, Commerce Secretary Howard Lutnick accused the university of breaching obligations under the 1980 Bayh-Dole Act and warned that Washington could exercise so-called “march-in” rights if Harvard does not comply. Lutnick directed Harvard to submit by Sept. 5 a detailed list of every patent arising from federal grants, including how the inventions are used and whether any licences require substantial U.S. manufacturing. Harvard holds more than 5,800 patents and over 900 technology licences, a trove analysts estimate to be worth hundreds of millions of dollars. The university did not immediately comment. The warning intensifies a months-long standoff between the White House and leading universities. Earlier on Friday, the Justice Department asked a federal judge to throw out Harvard’s suit challenging the administration’s suspension of its Student Visitor Exchange Program, which currently bars the Ivy League school from enrolling new international students. Higher-education tensions widened this week when Stanford University’s student newspaper and two former students filed a separate lawsuit alleging that arrests and deportation attempts against foreign students have chilled free speech on campus. The administration’s broader visa restrictions have already prompted concern that financially vulnerable colleges could lose critical tuition revenue and that U.S. research leadership may be undermined.
