The Supreme Court of Appeal (SCA) in Bloemfontein has overturned a High Court ruling that summarily acquitted eight accused individuals in the R24.9 million Nulane Investments fraud and corruption case linked to the Gupta family. The SCA found that the presiding judge, Acting Judge Nompumelelo Gusha, committed numerous legal errors, including misapplying the law and failing to consider the state's case adequately. As a result, the SCA has ordered a retrial with a new judge assigned to the matter. The National Prosecuting Authority (NPA) welcomed the ruling, viewing it as an opportunity to correct previous mistakes and expressed confidence in securing convictions in the retrial. The NPA spokesperson, Advocate Mthunzi Mhaga, indicated that the authority might pursue legal action against the former judge for her handling of the case. This judgment provides the NPA a renewed chance to prosecute the first State Capture case involving the multi-million-rand Nulane fraud.
