The Supreme Court of Appeal (SCA) in Bloemfontein has overturned the 2023 Free State High Court ruling that summarily acquitted eight accused individuals in the R24.9 million Nulane Investments fraud and money laundering case linked to State Capture and the Gupta family. The SCA found that the original judge committed numerous legal errors and has ordered a retrial with a new presiding judge. The National Prosecuting Authority (NPA) welcomed the ruling as a critical opportunity to correct previous prosecutorial mistakes and restore confidence amid recent setbacks. NPA spokesperson Advocate Mthunzi Mhaga described the decision as a lifeline for the first State Capture case. Following this, the NPA also launched efforts to reverse the invalidation of charges in a separate asbestos scam case involving the former personal assistant to Ace Magashule. Separately, former ANC spokesperson Pule Mabe and six others appeared in the Johannesburg Commercial Crimes Court for a corruption case related to a R27 million tender, but their case was postponed to July 7 to allow the NPA to finalize charges. Meanwhile, National Director of Public Prosecutions Shamila Batohi affirmed she will not resign despite pressure from political parties. Batohi highlighted the establishment of a Digital Evidence Unit to improve case analysis and noted that civil recovery agreements apply only to companies, not individuals. Additionally, the Gauteng High Court ruled that the South African Reserve Bank's Prudential Authority acted unlawfully in informally objecting to businessman Sipho Pityana's 2021 nomination as Absa Bank chair.
