On June 30, 2025, she appeared for her second arraignment at the Federal High Court in Abuja over alleged defamation of Senate President Godswill Akpabio and former Governor Yahaya Bello. The court granted her bail on self-recognition and set September 22, 2025, for the commencement of her cybercrime trial. On July 4, 2025, the court found her guilty of contempt for a satirical apology posted on Facebook and fined her ₦5 million. The same day, the court ruled that the Senate's six-month suspension of Akpoti-Uduaghan was beyond its powers, nullified the suspension, and ordered her immediate recall to the Senate. Despite the court order, the Senate has imposed conditions for her reinstatement and has not yet reinstated her. The Senate President, Godswill Akpabio, has appealed the court ruling. Akpoti-Uduaghan has petitioned the Senate to comply with the court judgment and formally requested reinstatement, indicating her intention to resume legislative duties on July 15, 2025, though she initially delayed her return citing legal advice. The Senate insists she remains suspended pending review of the certified court judgment. Civil society groups have called on the Senate to respect due process and comply with the court order. Additionally, the Senate has removed Akpoti-Uduaghan as chairperson of the Senate Committee on Diaspora and Non-Governmental Organisations. The court has also scheduled October 3, 2025, for judgment on a suit filed by Kogi Central constituents against her suspension.
