The Court of Appeal in London has rejected a bid by the Solicitor General to increase the sentence of triple murderer Nicholas Prosper to a whole-life order, concluding that the existing term is not unduly lenient. Prosper, now 19, was jailed in March for life with a minimum term of 49 years after admitting the 2023 murders of his mother, Juliana Falcon, 48, and siblings Giselle, 13, and Kyle, 16, at their Luton home. Prosecutors argued that the "exceptional" nature of the crimes warranted a whole-life tariff, which would have made Prosper the first offender aged 18–20 to receive such a penalty since sentencing rules changed in 2022. Delivering the decision, Lady Chief Justice Baroness Carr, sitting with Mr Justice Goss and Mr Justice Wall, ruled that the seriousness of the offences was addressed by the existing life sentence and that a whole-life term was not justified given Prosper’s age and guilty pleas. As a result, Prosper will remain eligible for parole no earlier than his late 60s, but may never be released if assessed as still dangerous.
