Former President Donald Trump on Monday asked a federal judge in Miami to order News Corp. founder Rupert Murdoch to sit for a videotaped deposition within 15 days in Trump’s $10 billion defamation lawsuit against the Wall Street Journal. In a court filing, Trump’s lawyers said Murdoch’s advanced age—94—and reported recent health issues could make him unavailable to testify at trial, warranting a de bene esse deposition that could be used later if necessary. Trump sued Murdoch, Dow Jones and several Journal reporters on July 18, alleging the newspaper acted with “actual malice” when it published a July 17 story claiming Trump wrote a sexually suggestive 2003 birthday greeting to the late financier Jeffrey Epstein. Trump denies authoring the note and says he warned Murdoch before publication that the document was a fake. Judge Darrin P. Gayles has given Murdoch until Aug. 4 to respond to the deposition request. Dow Jones has said it has “full confidence” in the Journal’s reporting and intends to fight the suit. The case adds to a series of high-profile defamation battles involving both Trump and Murdoch-controlled media properties.
