The allegations, first published by Just the News and confirmed in a separate Fox News report citing the same documents, stem from at least six FBI interviews conducted between 2017 and 2023. According to the memos, the whistleblower—described as a decade-long committee employee—said he attended a staff meeting where Schiff told aides the material would be leaked and used "to indict President Trump." The staffer characterized the plan as "unethical," "illegal," and "treasonous," but said colleagues argued congressional immunity under the Constitution’s Speech or Debate Clause would shield them from prosecution. The same witness also pointed to Rep. Eric Swalwell as a likely conduit for some of the disclosures. The records were provided to Congress by FBI Director Kash Patel, who has launched a broader review of past leak investigations. Despite the whistleblower’s repeated warnings, Justice Department prosecutors reportedly declined to move forward, and the five-year statute of limitations on most leak-related offenses has now expired.
